A BILL to amend article three, chapter five-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section forty- seven-a, relating to exempting the division of public safety from having to use the department of administration to sell or dispose of surplus property.

Be it enacted by the Legislature of West Virginia:
That article three, chapter five-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section forty-seven-a, to read as follows:
ARTICLE 3. PURCHASING DIVISION.

§5A-3-47a. Division of public safety exempted.
Notwithstanding any provisions or limitations of this article, the superintendent of the division of public safety is authorized and empowered to sell, offer in trade, and trade in,any vehicle, aircraft, boat, trailer, or other transportation fleet equipment in private sale, intergovernmental trade or sale, or public sale, by means of sealed bid, auction sale or arms length negotiation, so long as said sale or trade therefrom and the money or value received is used solely for the acquisition, maintenance of transportation management of the division of public safety fleet. All intergovernmental preferences and procedures established by section forty-five, article three, chapter five-a of this code and by the properly promulgated rules of the department of administration, not in direct conflict herewith, shall be adhered to by the division of public safety in administering this section.



NOTE: The purpose of this bill is to exempt the Division of Public Safety from having to use the Division of Finance and Administration to sell or dispose of its surplus transportation property.
